These conditions of sale are concluded on the one hand by Parti Pirate, political party and manager of the site https://boutique.partipirate.org and, on the other hand, by any person or entity wishing to make a purchase via the website https://boutique.partipirate.org hereinafter referred to as "the buyer".

Article 1. Purpose

These conditions of sale are intended to define the contractual relationship between Parti Pirate and the buyer and the conditions applicable to any purchase made through the website https://boutique.partipirate.org. The acquisition of a product through this site implies acceptance without reservation by the buyer of these conditions of sale which the buyer acknowledges having read prior to his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site https://boutique.partipirate.org is not directly related to his professional activity and is limited to a strictly personal use and on the other hand have full legal capacity, allowing him to commit under these general conditions of sale. The Parti Pirate retains the possibility to modify at any time these conditions of sale, in order to comply with any new regulation or in order to improve the use of its site. Therefore, the applicable conditions will be those in force at the date of the order by the buyer.

Article 2. Products

The products offered are those listed on the site https://boutique.partipirate.org of the Parti Pirate, within the limits of available stocks. The Parti Pirate reserves the right to change at any time the range of products. Each product is presented on the website in the form of a description of its main technical characteristics. The photographs are as accurate as possible but do not commit the Seller. The sale of the products presented on the website https://boutique.partipirate.org is intended for all buyers residing in the countries of the European Union.

Article 3. Prices

The prices listed on the product sheets of the Internet catalogue are prices in Euros (€). The Parti Pirate reserves the right to change prices at any time, but it is understood that the price listed in the catalogue on the day of the order will be the only one applicable to the buyer. The prices indicated do not include shipping costs, charged in addition to the price of products purchased according to the total amount of the order. For all orders under 150 euros including VAT, shipping costs will be charged to the buyer, the amount of which will be calculated according to the total weight of the order and according to the current rates of the carriers (Colissimo, Mondial Relay and La Poste).

Article 4. Order and payment terms

Before placing an order, the buyer can create an account on the website https://boutique.partipirate.org. The account creation section is accessible directly from the menu bar. At each visit, the buyer, if he wants to order or consult his account (status of orders, profile ...), can identify himself with his information. The Parti Pirate offers the buyer to order and pay for its products in several steps, with the payment options of choice via : - Secure payment by Verifone or credit card (via the Verifone system): the buyer selects the products he wants to order in the "basket", modify if necessary (quantities, references ...), check the delivery address or fill in a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of his choice: "Payment by Verizon". The next step is to check all the information, read and accept the present general terms and conditions of sale by ticking the corresponding box, and then to validate the order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the secure Vérifone interface in order to safely enter their Vérifone account or personal credit card details. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by Vérifone account or by credit card is irrevocable. In the event of fraudulent use of the card, the buyer may demand the cancellation of the payment by card, and the sums paid shall then be credited back or refunded. The responsibility of the bank card holder is not engaged if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or even 120 days if the contract linking him or her to the bank so provides. The amounts debited will be reimbursed by the bank within a maximum of one month after receipt of the cardholder's written objection. No costs for the return of the sums may be charged to the holder. Article 5. Reservation of ownership

The Parti Pirate retains full ownership of the products sold until full payment of the price, in principal, fees and taxes included.

Article 6. Withdrawal

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for the cost of return.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. Deliveries are made by carrier, delivery service with tracking, delivery without signature. The delivery times are given only as an indication; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. The Parti Pirate may provide by e-mail to the buyer the tracking number of his package. The buyer is delivered to his home by his factor. In case of absence of the buyer, he will receive a notice of passage of his factor, which allows him to withdraw the products ordered at the nearest post office, during a period indicated by the postal services. The risks associated with transport are the responsibility of the buyer from the moment the items leave the premises of the Parti Pirate. The buyer is required to verify in the presence of the employee of the Post Office or the deliveryman, the condition of the packaging of the goods and its contents upon delivery. In case of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 8. Guarantee

All products supplied by the Parti Pirate benefit from the legal guarantee provided by Articles 1641 and following of the Civil Code. In case of non-compliance of a product sold, it may be returned to the Parti Pirate who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by mail to the following address: Parti Pirate, 21 Place de la République, 75003 Paris, within thirty days after delivery.

Article 9. Responsibility

The Parti Pirate, in the process of distance selling, is held only by an obligation of means. Its responsibility can not be held liable for any damage resulting from the use of the Internet such as data loss, intrusion, viruses, service failure, or other unintended problems.

Article 10. Intellectual property

All elements of the site https://boutique.partipirate.org are and remain the exclusive intellectual property of the Parti Pirate. Nobody is allowed to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text.

Article 11. Personal data

The Parti Pirate undertakes to preserve the confidentiality of information provided by the buyer, which he would be required to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of 6 January 1978. As such, the Internet user has the right to access, modify and delete information concerning him/her. Article 12. Settlement of disputes

These conditions of distance selling are subject to French law. For all disputes or litigation, the competent court will be that of Paris.
